INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of MyFitnessCal (the "App"), a health and fitness calorie tracking application developed and operated by RandomHit LLP ("Company", "we", "our", or "us"), a Limited Liability Partnership registered under the laws of India.

By downloading, installing, registering for, or using MyFitnessCal, you ("User", "you", or "your") agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the App.

These Terms apply to all versions of the App, including any updates or new features released in the future. We reserve the right to update these Terms at any time, and your continued use of the App following such updates constitutes your acceptance of the revised Terms.

1. ELIGIBILITY

1.1 You must be at least 13 years of age to use MyFitnessCal.

1.2 If you are between the ages of 13 and 18, you must have the consent of a parent or legal guardian to use the App.

1.3 By using the App, you represent and warrant that you meet the above eligibility requirements and that you have the legal capacity to enter into a binding agreement.

1.4 The App is currently available exclusively on the Google Play Store and is intended for users with compatible Android devices.

2. ACCOUNT REGISTRATION

2.1 To access the full features of MyFitnessCal, you must create an account. You may register using Google Sign-In, which is the primary authentication method.

2.2 When you sign up, you will be asked to provide personal information including your name, gender, height, current weight, and fitness goals. You agree to provide accurate, current, and complete information during registration.

2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect any unauthorised access to your account, you must notify us immediately at support@randomhit.site.

2.4 We reserve the right to terminate or suspend accounts that we reasonably believe have been created fraudulently, are being misused, or are in violation of these Terms.

2.5 You may not create more than one personal account. Creating multiple accounts to circumvent suspensions or restrictions is strictly prohibited.

3. DESCRIPTION OF THE APP AND FEATURES

MyFitnessCal is a health and wellness application that provides the following core features:

Calorie and Nutrition Tracking: Users can log their daily food and beverage intake by typing text descriptions or by scanning food photos. The App calculates and displays estimated calorie counts along with macronutrient breakdowns including carbohydrates, protein, and fat.

Photo-Based Food Logging: Users can take or upload photos of their meals. The App uses artificial intelligence to identify the food items in the photo and estimate nutritional values.

Water Intake Tracker: Users can log their daily water consumption and track progress toward a personalised hydration goal.

Weight Tracking: Users can log their body weight daily and monitor changes over time.

Reminders and Notifications: The App provides customisable push notification reminders for meals (breakfast, lunch, and dinner), water intake, and daily weigh-in.

AI-Powered Recommendations: Based on the user's profile and logged data, the App generates personalised nutritional insights and recommendations using artificial intelligence models.

Weekly Summary: Users can view a weekly overview of their average calorie intake and macronutrients, along with AI-generated insights about their nutrition patterns.

We may add, modify, or remove features at any time at our discretion.

4. HEALTH DISCLAIMER AND LIMITATION OF ADVICE

4.1 MyFitnessCal is a wellness and self-tracking tool designed for informational and general wellness purposes only. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.

4.2 The calorie estimates, nutritional data, AI-generated recommendations, and all other health-related content provided by the App are intended for general informational purposes and are not a substitute for professional medical, dietary, or nutritional advice.

4.3 The accuracy of nutritional information derived from photo scans and AI analysis is estimated and may not be precise. Caloric values, portion sizes, and macro calculations are approximations only.

4.4 You should consult a qualified healthcare professional, doctor, registered dietitian, or nutritionist before making any significant changes to your diet, exercise routine, or health regimen, especially if you have or suspect you have any medical condition including but not limited to diabetes, heart disease, eating disorders, obesity, or any chronic health condition.

4.5 RandomHit LLP is not responsible for any health outcomes, injuries, illnesses, or adverse effects that may arise from reliance on the information provided by the App.

4.6 If you are pregnant, breastfeeding, recovering from illness, or under the care of a medical professional, please consult your healthcare provider before using the App to make dietary changes.

5. ARTIFICIAL INTELLIGENCE AND DATA ACCURACY

5.1 The App uses artificial intelligence and machine learning models to provide food recognition, calorie estimation, and personalised insights. These AI systems are designed to assist users and are not infallible.

5.2 AI-generated content, including food identification from photos and nutritional recommendations, may contain errors or inaccuracies. You acknowledge that such outputs are estimates and should be verified where precision is important.

5.3 We continuously work to improve the accuracy of our AI systems, but we make no warranties or guarantees regarding the completeness or accuracy of AI-generated results.

5.4 You agree not to rely solely on AI-generated nutritional analysis for medical or clinical purposes.

6. USER RESPONSIBILITIES AND ACCEPTABLE USE

6.1 You agree to use MyFitnessCal only for lawful purposes and in accordance with these Terms.

6.2 You agree not to:

a) Use the App in any way that violates applicable local, national, or international laws or regulations. b) Attempt to gain unauthorised access to any part of the App, its servers, or any associated systems or networks. c) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App. d) Upload, transmit, or share content through the App that is false, misleading, offensive, harassing, or violates the rights of others. e) Use the App to harm, stalk, harass, or intimidate other users or third parties. f) Use automated tools, bots, scripts, or other automated means to access or use the App. g) Circumvent, disable, or interfere with any security-related features of the App. h) Use the App to collect or harvest personal data of other users. i) Impersonate any person or entity or misrepresent your affiliation with any person or entity. j) Use the App in any manner that could damage, disable, overburden, or impair the functionality of the App or its underlying infrastructure.

6.3 You are solely responsible for all content you submit, log, or share through the App, including food logs, weight data, and any text inputs.

7. INTELLECTUAL PROPERTY

7.1 The App, including but not limited to its design, logo, user interface, text, graphics, software, code, AI models, and all other content, is owned by or licensed to RandomHit LLP and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

7.2 The "MyFitnessCal" name and logo are the property of RandomHit LLP. You may not use our trademarks, logos, or branding without prior written permission.

7.3 We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on your personal Android device solely for your personal, non-commercial use, subject to these Terms.

7.4 You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App or its content without our express written permission.

7.5 Any feedback, suggestions, or ideas you submit to us regarding the App may be used by us freely and without obligation or compensation to you.

8. THIRD-PARTY SERVICES AND LINKS

8.1 The App integrates with third-party services, including Google Sign-In and AI processing platforms. Your use of these services is subject to their respective terms and privacy policies. We encourage you to review those policies.

8.2 We are not responsible for the content, practices, or policies of any third-party services integrated into or linked from the App.

8.3 The App is distributed through the Google Play Store. Your use of the Google Play Store is subject to Google's Terms of Service.

9. SUBSCRIPTIONS, PURCHASES, AND BILLING

9.1 MyFitnessCal may offer free features and, in the future, optional premium features or subscription plans. Any such offerings will be clearly described within the App.

9.2 If the App introduces paid features, all applicable pricing, billing terms, and cancellation policies will be disclosed to you before any purchase. By making a purchase within the App, you agree to the applicable payment terms presented at that time.

9.3 All in-app purchases are processed through the Google Play Store, subject to Google Play's billing terms and conditions.

9.4 We reserve the right to change, discontinue, or modify pricing and subscription plans at any time with reasonable notice.

10. TERMINATION

10.2 We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law.

10.3 Upon termination, your right to use the App ceases immediately. We may retain your data as described in our Privacy Policy.

11. DISCLAIMERS AND LIMITATION OF LIABILITY

11.1 The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

11.2 We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11.3 To the fullest extent permitted by applicable law, RandomHit LLP, its partners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

a) Your use of or inability to use the App b) Any errors or inaccuracies in the App's content, including nutritional data or AI-generated outputs c) Any health outcomes resulting from reliance on the App's recommendations d) Unauthorised access to or alteration of your data e) Any other matters relating to the App

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RandomHit LLP and its officers, partners, employees, agents, successors, and assigns from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

a) Your use of the App b) Your violation of these Terms c) Your violation of any applicable law or regulation d) Any content you submit or transmit through the App e) Your violation of any rights of a third party

13. PRIVACY

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. 14. MODIFICATIONS TO THE APP AND TERMS

14.1 We reserve the right to modify, update, or discontinue the App (or any part of it) at any time, with or without prior notice.

14.2 We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of these Terms and, for material changes, notify you through the App or via email.

14.3 Your continued use of the App after changes to these Terms are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved amicably through good faith negotiations between the parties. You may contact us at support@randomhit.site to initiate this process.

15.3 If the dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the competent courts located in Sri Ganganagar, Rajasthan, India.

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RandomHit LLP regarding your use of MyFitnessCal and supersede all prior agreements, understandings, or representations, whether written or oral, relating to the same subject matter.

18. WAIVER

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver of any provision of these Terms must be in writing and signed by an authorised representative of RandomHit LLP.
